Said Terms and Conditions have been drawn up in accordance with the corresponding legislation currently in effect, including, but not limited to, Royal Decree 1/2077 of 16th November, whereby the amended text of the General Law for the Defence of Consumers and Users was passed, as well as other additional laws, and Law 34/2002 on Information Society Services and Electronic Commerce, and Law 59/2003 of 19th December on Electronic Signatures.

ABADIA RETUERTA SA reserves the right to deregister and prevent access to any clients holding outstanding or unpaid debts to ABADIA RETUERTA SA.
3. Purchasing products at abadia-retuerta.com
At all times the website shall include the products on sale, together with their characteristics and retail price in each of the corresponding sections: 1. – Wines; 2. – Estate Products; 3. – Gifts. The wines and all other products containing alcohol shall only be sold to persons of legal age, who must make a statement to this effect when placing their orders.
ABADIA RETUERTA SA shall decide at any given time the products offered for sale to its customers via the website.
Consequently, ABADIA RETUERTA SA may add or withdraw references to the product catalogue available at abadia-retuerta.com, undertaking at all times to fulfil those orders placed previously and the duration of any campaigns or specific offers it has made.
Pursuant to the legislation in effect, the sale or provision of alcoholic beverages to minors via this website is forbidden.
3.1. Price details
The prices of the products available for purchase are given in euros and are inclusive of Value Added Tax (VAT).
3.2. Payment methods
Payment may be made by credit or debit card via the BBVA/Redsys Secure Payment Terminal, or by suing the PayPal or IUPAY systems.
3.2.1 Bank card payment
The BBVA/Redsys Virtual Payment Terminal (VPT) accepts the following cards: American Express, Master Card, Maestro, Visa and Visa Electron. When paying by card users must provide the card number, the expiry date, the cardholder’s name and surname (as stated on the card) and the card CVV number.
The order total will be charged to customers’ bankcard at the time of purchase. In order to provide maximum protection against possible fraud, customers will be required to provide their card details each time they make a purchase, Abadia Retuerta SA does not have access to or store its customers’ bank details.
This trader undertakes not to permit any illegal transactions, or any transactions that in the opinion of the credit card companies or purchasing banks that may potentially damage their goodwill or have a negative impact on them. The following activities are forbidden by virtue of the card company programmes: the sale or offer of a product or service that fails to fully conform to laws applicable to Buyers, Issuing Banks, Traders, Cardholders or Cards.
3.2.2 Payment with PayPal y IUPAY
The order total will be charged to the customers’ PayPal account at the time of purchase. In order to provide maximum protection against possible fraud, customers will be required to provide their card details each time they make a purchase, Abadia Retuerta SA does not have access to or store its customers’ bank details.
ABADIA RETUERTA SA shall only deliver orders to Spain (mainland and the Balearic Islands).
During the order processing phase, if a product is found not to be available, customers will be contacted by telephone to inform them of the lack of availability and to attempt to find a solution.
3.4. Shipping Costs
Shipping costs shall be paid with the order total and details included on the invoice. A charge of 9.00 euros shall apply to each order.
Shipping will be free of charge on orders over 100 euros.
3.5. Confirmación del pedido
Customers must confirm their order by clicking on the ‘Continue’ button during the payment process. Once this confirmation has been made, the order shall be considered definite and final. It will be automatically recorded and ABADIA RETUERTA SA will proceed with the delivery.
The automatic recording of the order placed shall act as proof of its type, contents and date. By confirming an order, customers accept the prices, description of the products offered, shipping costs and all other terms and conditions concerning the sale of the product, as specified in this document. Once the purchase process is complete, the system will provide customers with confirmation of the order placed via the website. This confirmation will also be sent to the email address provided on registration.
The order confirmation and proof of purchase (as printed out by the user) shall not be a valid as an invoice.
The corresponding invoice shall be attached to the corresponding order and included in the order.
3.6. Order tracking
Customers may track their order status at any time via the website under the ‘My account’ section.

3.7. Order delivery periods
As stated above, the ABADIA RETUERTA SA online store at abadia-retuerta.com does not deliver to the whole of Spain, only the Spanish mainland and the Balearic Islands.
Orders will be delivered to the address provided by customers once the order has been placed within 48 to 72 working hours (excluding Saturdays, Sundays and Public Holidays), although this may vary depending on the product availability or the delivery address. If customers are not in when the delivery is made, a note will be left with details of how to contact the transport agency to agree on a new delivery date. A second delivery attempt will be made only if the customers contact the transport agency in order to arrange a date. The order will remain on the transport agency facilities for 15 calendar days, after which time it will be returned to Abadia Retuerta. Once this period has elapsed, customers claiming their orders will be required to pay the shipping costs again.

Alternatively, the order shall be handed over to any person of legal age who is present at the address given at the time of delivery. Customers specifically authorise ABADIA RETUERTA SA to hand over the delivery in their favour. The person taking delivery of the order must sign the corresponding delivery note, including their name and ID card number or similar, which implies their conformity with the products received both in terms of their quality and quantity and the condition in which they are delivered.
In this sense, recipients may make all necessary checks on the order at the time of delivery in order to express their conformity therewith. If any items are missing, this must be specifically stated on the corresponding delivery note.
3.8. Proof of operations
Acceptance of orders by ABADIA RETUERTA SA as well as information regarding any operations made using the corresponding order number and all other documents generated shall be stored and filed, acting as evidence in the event of any dispute.
4. Products returns
4.1. Rigth of whithdrawal
Pursuant to legislation in effect, customers have a maximum of fourteen (14) calendar days following the product delivery in order to partially or totally withdraw from the purchase of any product. Pursuant to article 102. d) of Legislative Royal Decree 1/2007 of 16th November, passing the amended text of the General Law for the Defence of Consumers and Users and other additional laws, the right of withdrawal does not apply to any bottles that have been opened, or, in the case of products delivered in wooden cases, to cases of wine that have been opened or their seals broken causing the case to break or tear. Likewise, the right of withdrawal shall not apply to any personalised products.
Once the fourteen (14) calendar day period has ended, Abadia Retuerta shall not accept any returns corresponding to the withdrawal of product purchases.

In all cases, in the event of withdrawal from a purchase, the following requirements must be met:
Products must be in the same condition as when delivered and must returned with their original packaging and labels.
Items must be returned to Abadia Retuerta in the same box as they were delivered in, or alternatively in a similar format that guarantees that the products will be returned in perfect condition (with the exception of items delivered in wooden cases, in which case they may only be returned in the same unopened case).
In order to exercise their rights, in addition to returning the actual items, customers must also inform us that they wish to exercise their right of withdrawal by completing the form included in Annex 1 entitled ‘Standard form for right of withdrawal and contents thereof’ or by a document with similar contents, even though it does not coincide exactly with the standard form. This form must be sent by email to Pedidosonline@abadia-retuerta.es, or by fact to +34 983680286, or by a physical form of delivery whereby proof of the date of delivery is provided to the address given above, within the corresponding 14 day period. ABADIA RETUERTA will acknowledge receipt of said documents.

In the event of withdrawal, the refund shall include all shipping costs paid by the customer on making the purchase. However, ABADIA RETUERTA is entitled to charge any additional shipping charges in the event of non-standard shipping method or express delivery. In all cases, in the event of withdrawal, the cost of returning items to ABADIA RETUERTA shall be payable by the customer.
4.2. Return of faulty products
Without prejudice to any other rights to which they may be entitled, customers shall be entitled to a refund of the price of faulty products or products that do not match the order placed by Users. Alternatively, users shall be entitled to request and receive an identical replacement product in perfect condition.
Faulty products or items that do not match the order placed must be returned to Abadia Retuerta by customers using the procedure stipulated in section (4.1) above. However, in this case, customers shall not be liable for the cost of returning said items.
Provided that Users have complied with the procedure stipulated in section (4.1) above and have met the requirements included in this section, Abadia Retuerta shall refund the amount corresponding to the returned products that are faulty or do not match the product order placed by customers, pursuant to the terms specified in section (4.3) below.
4.3. Refund of product price
Provided that Customers have complied with the procedure stipulated in this section and met the requirements contained therein, Abadia Retuerta shall refund the amount paid by the Customers for the returned products and the shipping costs, except in the case of a non-standard shipping method or express delivery. If the refund corresponds to Users’ right of withdrawal, as specified in section (4.1), Abadia Retuerta shall not be liable for the expenditure and/or costs of returning the product to ABADIA RETUERTA
Customers shall not be entitled to a refund of the price of any returned products that are not in the same condition as when delivered, or that fail to meet the requirements stipulated in these General Terms and Conditions.
Partial returns of an order will imply the refund of the price of the item or items actually returned.
Abadia Retuerta shall process the price refund via the same payment method used by Customers to acquire the products within a period of fourteen (14) days following collection of the returned order and once Abadia Retuerta has checked that the returned items meet the requirements stipulated in sections (4.1) and (4.2) above. Crediting customers’ accounts with the refund shall be the responsibility of the bank.

7. Applicable legislation, consent of jurisdiction
This agreement shall be governed by Spanish laws which shall be applicable to all matters not included in this agreement in terms of interpretation, validity and execution thereof. All disputes arising from the contract of products via this website shall be submitted to the competent jurisdictional bodies as determined by the Law.
